Since its enactment in 1938, Minimum wage has been referred to as a “cornerstone” of our federal labor laws. The federal minimum wage is $7.25 per hour. 29 USC § 206. California’s minimum wage is $8.00 per hour rising to $9.00 by July 2014, and $10.00 by January 2016. Even if an employee voluntarily agrees to work for less, the employer is still liable to the employee for the minimum wage (plus penalties if he paid less).
